I, ROBERT ELDER SR.,of the ---- of Lin & ---- Ky being of sound &disposing mind & memory do hereby make & ordain this to be my last will & test in manner and form following hereby revoking all other Item first After the payment of my just debts & funeral expenses by my ex hereafter to be named. I give and bequeath to my daughter Mary Pemberton, Rebeccah McCormack & Jane Short 2 hun $ each to be give to them so soon as the money can be obtained after my death by my said ex-
2nd all the balance of my estate I hereby give to my 5 sons. Namely Matthew Elder, Andrew E, James E, Robt E, Wm E, to be = divided amongst them as follows: I give to my son Andrew E. 4 of my Negroes with all the increase from this date. Namely Jemima, Alfred, Amanda, & Green as the price of one share & 50 $ & should said Negroes_____ to move then his = fifth part he is to pay in money to the other of my sons so as to make them = & as I have undivided possession of sd Negroes above named to my son Andrew he is not to pay any hice for them & whereas I have were unto a matter article of agreement with my said sons Andrew, Robt E expecting my Negroes here given to them, I hereby refer to sd article in the hands of Geo G Miller & hereby ratify and confirm the title to them as herein expressed. 3rd I give & bequest to my son Robt E. my Negro girl named Susan & my Negro boy Evan with all increase of any from this date as be ----- of one share $ to come out of his part of my estate & should they amount to more than his fifth share he is to refund to the other sons as to make all 5 sons =. As I wish it here fairly understood that after my daus above named receive their legacies, the balance to be = divided amongst my 5 sons. Only my two sons Andrew & Robert is to have Negroes so as above described & if they ____ to more than their share they are to refund as before expressed to the others so as to make all five sons = hereby reserving the right of obtaining possessions as long as I live and have given up the negrs Susan and Shelby as above described to my son Robt E. he is not to pay any hire for them. Lastly, I hereby constitute & affirm my son Andrew E. and my trusty friend James Wallace of-------
